A condition for an agreement between Chowan County and Edenton to move the Confederate Monument has not been met, meaning the monument will stay at its location on South Broad Street for now.

The Chowan County Board of Commissioners announced the receipt of a letter announcing the nullification the MOU at Monday’s meeting in the county public safety building.

The Edenton Town Council and County Commissioners approved the MOU in November. The agreement would have moved the statue from its current location on South Broad Street to behind the Chowan County Courthouse, near the veterans memorial.

The main condition for the agreement to move forward was for the plaintiffs in a civil action against moving the monument to sign off on the agreement. The plaintiffs included the United Daughters of the Confederacy and North Carolina Division of the Sons of the Confederate Veterans Inc.

According to the letter, the new attorney for the Sons of Confederate Veterans, James Barrett Wilson Jr., refused to sign the Consent Judgment that was approved by the organization’s former attorney Edward Phillips.

“Thus, the condition precedent (entry of a Consent Judgment) triggering the relocation of the Confederate Monument can no longer be satisfied because Mr. Wilson will not approve same,” the letter from Hood Ellis, attorney for the Town of Edenton.

“Given the above, please let me know on behalf of the Town of Edenton if the County would like to schedule a joint meeting to discuss entering a new Memorandum of Understanding and Agreement,” the letter read.

More information on the monument lawsuits and the meeting will be published on Tuesday, Feb. 4.
